Privacy and Camera Use
When using a drone with a camera, microphone or other sensor, respect other people’s privacy. A flight may comply with aviation rules while the recording, storage or publication of footage may still be restricted.
Respect people’s privacy
- Avoid recording people in homes, gardens, balconies or through windows.
- Do not record where people reasonably expect privacy.
- Seek consent when an identifiable person is the main subject.
- Keep a considerate distance from people and private property, even when not recording.
Publishing images and video
Consider obtaining consent before publishing identifiable images or video on social media, websites, video platforms, advertising or marketing materials. Permission to make a recording does not automatically include permission to publish it.
Business use
Australian Government agencies, organisations with annual turnover above $3 million, and some other organisations may be covered by the Privacy Act 1988 and the Australian Privacy Principles. Covered organisations should notify people before recording where practicable, collect only what is reasonably necessary, secure personal information and destroy or de-identify it when no longer needed.
State and territory laws
Surveillance-device, listening-device, trespass, nuisance and other laws vary by state and territory. Check the rules that apply where you are flying, as well as any landowner requirements.
Keeping footage secure
- Restrict access to recordings.
- Use secure storage and accounts.
- Avoid unnecessary sharing.
- Delete material when it is no longer needed.
- Protect memory cards, phones and cloud storage.
